Booking Online Payment Terms

These Online Payment Terms apply to the use of the PayPal-based online payment transaction service (the Service) for payment of fees for events publicised on the Centre for Leadership Performance (CfLP) website.

These Online Payment Terms constitute a contract between you and CfLP. Please read them carefully. To make payment using the Service you must accept the Terms, which you do when you make a purchase.

 
Online Payment Terms

Your Warranties

1 You confirm that:
 
  • you are aged 18 or over
  • you will perform your obligations in relation to the Online Payment Terms
  • all information supplied by you is true and correct
2 Payment
2.1 Payment may be made using PayPal, and these terms apply when PayPal is used.
2.2 Upon completing a booking for a CfLP event using the Services, you will be asked to verify the transaction details you wish to process. The CfLP shall not be liable in relation for inaccurate data entry in the course of the use of the Service or for loss of data or information caused by factors beyond CfLP's reasonable control.
2.3 CfLP's cancellation terms (which are on the booking form) apply.
2.4 CfLP accepts no responsibility for refusal or reversal of payments, which shall be a matter between you and PayPal, provided that if (for any reason) any payment made by you or on your behalf is reversed or charged back (so that a payment previously made to CfLP is withdrawn), you will immediately pay to CfLP in cash all sums then due from you to CfLP in relation to all relevant purchases made by you using the Service.
 
3 By using the Service you agree:
3.1 to provide all required information, in the format and to the standards required for each transaction.
3.2 that the information supplied by you may be retained by CfLP.
3.3 to receive information by electronic means.

 
Security

4 Payments using the Service are made through PayPal. You acknowledge and agree that internet transmissions cannot be guaranteed to be entirely secure or private and any information provided by you may be able to be read and/or intercepted by a third party. CfLP shall have no liability for the interception and/or 'hacking' of any data or other unauthorised access to information provided by you for the purposes of the Service, unless caused by CfLP's negligence.

 
Exclusion/Limitation of CfLP's Liability

5 To the extent permitted by law, CfLP does not accept liability for any indirect losses or consequential damage which may be suffered or incurred by you from use of the Service. If, for any reason, CfLP is found to be liable to you for any damage or loss which arises as a result of your use of the Service, CfLP's liability shall be limited to the amount paid by you through the Service.
 
6 Use/Availability of the Service
6.1 CfLP does not warrant or guarantee that the Service or your use of the Service will be error-free, immediate, virus free or continuously available.
6.2 CfLP reserves the right to suspend, amend or cancel the Service at any time either temporarily or permanently.

 
Indemnity

7 You agree to indemnify CfLP for any loss, cost or expense suffered or incurred by CfLP as a result of:
7.1 your breach of your obligations under the Online Payment Terms.
7.2 intentional misuse of the Service.
7.3 your negligent acts or omissions.
7.4 any claim brought against CfLP by a third party in relation to your use of the Service.

 
Governing Law

8 The Online Payment Terms are governed by English law. The Courts of England and Wales have exclusive jurisdiction over any matter in connection with the Service and these Online Payment Terms.
